Terms of Service

Overview

Welcome to Skingineer. Skingineer is a brand operated by IBNordica, CVR no. DK45511618, Kongovej 37, 2300 København S, Denmark (the "Company", "we", "us" and "our"). We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with skincare consultations, personalised skincare routines and related digital content (the "Services"). Skingineer is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

Your statutory rights as a consumer come first. If you are a consumer, nothing in these Terms removes or reduces the mandatory rights you have under Danish and EU consumer law, including your right of withdrawal and the statutory guarantee that services and digital content conform to the contract. Where any term conflicts with those mandatory rights, your statutory rights prevail.

Section 1 – Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old (the age of majority in Denmark). The Services are intended for adults and are not directed at children.

To use the Services, including browsing our store or purchasing any product or service, you may be asked to provide information such as your name, email address and payment details. You represent that the information you provide is correct, current and complete. You are responsible for keeping your account credentials secure and for activity under your account, and you may not transfer or sell your account to anyone else.

Section 2 – Our services and products

We make every effort to describe our consultations, routines and digital content accurately. Because skincare results depend on individual skin, lifestyle, product use and consistency, we cannot and do not guarantee any specific outcome or result. Our recommendations are professional, evidence-based guidance — not promises of a particular effect.

Important — not medical advice. Skingineer provides cosmetic skincare guidance based on professional training and scientific evidence. It is not medical advice and does not diagnose, treat, cure or prevent any disease or medical or dermatological condition. Our Services are not a substitute for consultation with a doctor, dermatologist or other qualified healthcare professional. You should seek medical advice before acting on any recommendation if you have a diagnosed skin condition, are pregnant or breastfeeding, take prescription medication or skincare, or have known allergies or sensitivities. Always patch-test new products and discontinue use and seek medical advice if you experience an adverse reaction. You use our recommendations at your own discretion.

We may change descriptions of our Services at any time and may discontinue or limit any Service on a case-by-case basis.

Section 3 – Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion, and your order is not accepted until we confirm acceptance and have received your payment. We will contact you using the details you provided if we are unable to accept, need to change, or cancel an order.

Cancellations, withdrawals and refunds are governed by our Refund & Right of Withdrawal Policy, which forms part of these Terms.

Our Services and digital content are licensed to you for your own personal, non-commercial use only. You may not resell, redistribute, publish or share the personalised routine, guide or other content we provide.

Section 4 – Prices and billing

All prices are stated in Danish kroner (DKK) and include applicable Danish VAT (moms). Because we supply services and digital content delivered electronically, there are no shipping, handling, customs or import charges.

Prices, discounts and promotions may change without notice, but the price that applies to your order is the price displayed at the time you place it, as confirmed in your order confirmation email. If a promotion has its own terms and they conflict with these Terms, the promotion terms govern for that promotion.

You agree to provide current, complete and accurate payment and account information, and to keep it up to date. You represent that the payment information you provide is true and that you are authorised to use the payment method.

Section 5 – Delivery of services and digital content

We do not ship physical goods. Your Services and digital content are delivered electronically as follows:

  • Free "Find Your Skintype" guide: delivered immediately as a digital download.
  • Customised Skincare Routine: prepared individually for you after you complete the intake questionnaire we email you, and delivered to you digitally.
  • 1:1 Consultation & Tailored Routine: after purchase you receive a short questionnaire (normally within 24 hours), followed by a scheduled 60-minute video consultation, after which your personalised routine is delivered (normally within one week).

Delivery times are estimates. If you do not receive your guide, questionnaire, booking details or routine, contact us at ida@ibnordica.com and we will resolve it.

Section 6 – Intellectual property

Our Services — including all trademarks, brand elements, text, images, graphics, video, audio, and the design, selection and arrangement of them, as well as the content of any guide, routine or consultation — are owned by IBNordica / Skingineer, its affiliates or licensors, and are protected by Danish, EU and international intellectual property laws.

These Terms permit you to use the Services and any content you receive for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display or republish any material from the Services, or resell or share your personalised routine or guide, without our prior written consent. Skingineer's names, logos and slogans are our trademarks and may not be used without our permission. Shopify's marks belong to Shopify, and all other marks belong to their respective owners.

Section 7 – Optional tools

You may be given access to third-party tools that we neither monitor nor control. We provide access to such tools "as is" and "as available" without warranties or endorsement, and we have no liability arising from your use of optional third-party tools. Any use is at your own risk, and you should review the relevant third party's terms. New features added in future form part of the Services and are subject to these Terms.

Section 8 – Third-party links

The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of third-party materials or websites, and if you access them you do so at your own risk. Please review the third party's policies before transacting with them, and direct any complaints about their products or services to them.

Section 9 – Relationship with Shopify

Skingineer is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Skingineer. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Skingineer, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Skingineer.

Section 10 – Privacy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's privacy policy. Because the Services are hosted by Shopify, information you submit is transmitted to and processed by Shopify in order to provide the Services. By using the Services, you acknowledge that you have read our Privacy Policy.

Section 11 – Feedback and reviews

If you submit ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute and display that Feedback for any purpose, including promoting the Services. You confirm that you own or have the rights to your Feedback, that it is accurate, and that it does not infringe anyone's rights or contain unlawful, abusive or malicious material. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it, and we may remove Feedback we consider objectionable.

Section 12 – Errors, inaccuracies and omissions

Occasionally there may be typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to change or update information, or cancel orders, if any information is inaccurate — including after you have submitted your order. Where this affects an order you have already paid for, we will inform you and refund you in full.

Section 13 – Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services: for any unlawful or malicious purpose; to violate any laws or regulations; to infringe our or others' intellectual property; to harass, abuse or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any person or entity; or to interfere with anyone's use of the Services.

You also agree not to: upload viruses or malicious code; reproduce, copy, resell or exploit any part of the Services; collect others' personal information; or use any robot, scraper, data-extraction tool or automated means to access the Services or bypass our security measures. We may suspend or terminate your account if you breach these Terms.

Section 14 – Agents

14.1 This section ("Agent Terms") applies if you use, enable or cause the deployment of an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, without direct supervision.

14.2 No Agent may access or interact with the Services unless it identifies itself and operates in accordance with Section 14.4, and no Agent may access the Services if we have asked it to refrain from doing so.

14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests identify that the request is from an Agent and disclose its name in the user-agent string as "Agent/[agent name]"; (ii) not conceal that interactions come from an Agent, including by mimicking human behaviour or circumventing CAPTCHAs; (iii) respond truthfully to any prompt seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to control how Agents access the Services.

Section 15 – Termination

We may suspend or terminate your access to the Services at our discretion where you breach these Terms or where required by law, and you will remain liable for amounts due up to the date of termination. The sections that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Governing Law and Privacy — will continue to apply.

Section 16 – Disclaimer of warranties

This section applies only to the extent permitted by law. If you are a consumer, it does not exclude or limit the statutory guarantee that our Services and digital content conform to the contract, or any other mandatory right you have under Danish and EU consumer law.

Subject to the above, information presented through the Services is provided for general information purposes, and except as expressly stated by us the Services are provided "as is" and "as available" without warranties or conditions of any kind, express or implied. We do not warrant that your use of the Services will be uninterrupted, secure or error-free.

Section 17 – Limitation of liability

This section applies only to the extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under Danish law. If you are a consumer, your mandatory statutory rights are not affected.

Subject to the above, we will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, savings or data, arising from your use of the Services. Where we are liable to a consumer, our liability is limited to loss that was reasonably foreseeable and arising from our breach of these Terms.

Section 18 – Indemnification

To the extent permitted by applicable law, and except where you are acting as a consumer in respect of matters protected by mandatory consumer law, you agree to indemnify and hold harmless IBNordica / Skingineer, Shopify, and our affiliates, officers, employees and service providers from claims and reasonable costs arising out of your breach of these Terms, your violation of any law or third-party right, or your misuse of the Services.

Section 19 – Consumer rights and right of withdrawal

If you are a consumer in the EU/EEA, you have a statutory right to withdraw from distance contracts within 14 days, subject to the exceptions set out in our Refund & Right of Withdrawal Policy. You also benefit from the statutory rights set out in the Danish Consumer Contracts Act (forbrugeraftaleloven) and related consumer legislation. These Terms do not affect those rights.

Section 20 – Complaints and dispute resolution

If you have a complaint, please contact us first at ida@ibnordica.com so we can try to resolve it directly.

If we cannot resolve it, consumers resident in Denmark or the EU may refer the matter to the Danish out-of-court complaints body, the Center for Klageløsning / Forbrugerklagenævnet, administered by Nævnenes Hus (see naevneneshus.dk for current contact details and conditions). We are not legally obliged to participate in alternative dispute resolution but will consider doing so in good faith.

Section 21 – Severability

If any provision of these Terms is held to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.

Section 22 – Waiver; entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. Any ambiguity will not be construed against the drafting party.

Section 23 – Assignment

You may not transfer or assign these Terms or your rights and obligations under them without our prior written consent. We may transfer or assign these Terms and our rights and obligations, provided this does not reduce your rights as a consumer.

Section 24 – Governing law and jurisdiction

These Terms are governed by the laws of Denmark. Disputes will be subject to the jurisdiction of the Danish courts.

If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of the country in which you live, and you may bring or defend proceedings in the courts of your country of residence where EU law (including Regulation (EU) No 1215/2012 and Regulation (EC) No 593/2008) so provides.

Section 25 – Changes to these Terms

You can review the current version of these Terms at any time on this page. We may update or replace any part of these Terms by posting changes to our website, and we will notify you of material changes as required by law. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Section 26 – Headings

Headings are for convenience only and do not affect the interpretation of these Terms.
